How Maryland FAMLI contributions work

FAMLI is Maryland's paid family and medical leave insurance. It is paid for by a contribution on wages, split between workers and employers, much like Social Security. For wages paid from January 1 through December 31, 2027 the total rate is 0.9% of wages. Employers may deduct up to half of it, 0.45%, from employee pay; they may also choose to pay all of it. Employers with fewer than 15 employees in total owe only the employee share, which they may still deduct.

Contributions apply only to wages up to the Social Security wage base, which SSA set at $192,300 for 2027. Employers report and pay quarterly; the first payment, for wages paid January 1 to March 31, 2027, is due April 30, 2027. The Department of Labor sets the rate each year, and by law the total can never exceed 1.2% of wages.

Benefits start in January 2028: up to 12 weeks of paid leave in a 12-month period, at 90% of your average weekly wage when that wage is no more than 65% of the state average, and never more than $1,000 a week.

The 2028 rate and wage base have not been published yet. The Department of Labor announces each year's rate in November, and SSA publishes the wage base each October.

Frequently asked questions

When do Maryland FAMLI deductions start?
With wages paid on or after January 1, 2027. A paycheck dated December 31, 2026 or earlier has no FAMLI deduction, even if some of the work was done earlier. Employers send their first contributions, for wages paid January 1 to March 31, 2027, by April 30, 2027.
How much is the Maryland FAMLI deduction?
The 2027 contribution rate is 0.9% of wages. Employers may deduct up to half, 0.45%, from employee pay and pay the rest. On $2,000 of wages that is at most $9.00 from your check.
Is there a maximum FAMLI contribution?
Yes. Contributions apply to wages up to the Social Security wage base, $192,300 in 2027, so the most an employee can pay for the year is $865.35. Once your 2027 wages pass that amount the deduction stops for the rest of the year.
Do small employers have to pay FAMLI?
Employers with fewer than 15 employees in total, counting staff inside and outside Maryland, do not pay the employer share. They still collect and send the employee share, so a worker at a small business can still see up to 0.45% deducted.
When can I take paid leave under FAMLI?
Benefits begin in January 2028. Eligible workers can take up to 12 weeks in a 12-month period. The weekly benefit is 90% of your average weekly wage if that wage is 65% or less of the state average weekly wage, with a smaller percentage on wages above that level, and it can never exceed $1,000 a week.
Does a 401(k) contribution reduce the FAMLI deduction?
No. FAMLI contributions are figured on wages, like Social Security, so pre-tax retirement deferrals do not lower them. FAMLI is not an income tax.
